The Federal Constitutional Court determined the fee-relevant value of the subject matter in an organ dispute. § 37 Abs. 2 RVG; value assessment in constitutional organ dispute proceedings and in ancillary interim relief proceedings: the subject-matter value for attorney-fee purposes is to be fixed separately for the main proceedings and for interim proceedings according to their respective significance. The Court may determine distinct values where the provisional procedure has a substantially lower practical and legal weight than the principal matter. The assessment is discretionary and reviewable only within the limits of statutory valuation principles; the concrete fixing in the individual case reflects that differentiation (cf. reasons, especially consid. 1).

Der Wert des Gegenstandes der anwaltlichen Tätigkeit im Hauptsacheverfahren wird auf 1.000.000 € (in Worten: eine Million Euro) und im Verfahren auf Erlass einer einstweiligen Anordnung auf 100.000 € (in Worten: einhunderttausend Euro) festgesetzt (§ 37 Abs. 2 RVG).
