Résumé Omnilex

The Federal Social Court held that the claimant's request to set aside the EUR 500 vexatious-costs order from the Bavarian LSG judgment was inadmissible. Section 192(3) sentence 2 SGG applies only after withdrawal of the action and does not allow a separate challenge to a costs order contained in a judgment. The court therefore rejected the request. It also ordered that the parties bear no costs of the present proceedings.

Regeste Omnilex

§ 192 Abs. 3 S. 2 SGG; separate challenge to a costs order in the judgment inadmissible. The remedy provided for the situation of withdrawal of an action cannot be extended to a costs decision embedded in a judgment. Such a costs order is not independently appealable; an attempted conversion into another admissible remedy is excluded (consid. 4). The inadmissible application is to be rejected under § 160a Abs. 4 S. 1 i.V.m. § 169 SGG. Costs of the complaint proceedings are allocated by analogous application of § 193 Abs. 1 SGG (consid. 5).

Nichtzulassungsbeschwerde - Aufhebung der Entscheidung über die Auferlegung von Mutwillenskosten

Tenor
