Résumé Omnilex

The Federal Court dismissed the defendants’ revisions against the LG Hechingen judgment as unfounded and ordered each appellant to bear the costs of his own appeal. In an additional remark, it held that the 2016 amendment of the human-trafficking provisions did not affect the conviction of K., because the old and new provisions maintained continuity of the offense conduct within the meaning of Art. 2(3) StGB; the trial court had therefore correctly relied on the law in force at completion of the offence.

Regeste Omnilex

Art. 2 Abs. 3 StGB; §§ 232, 232a StGB as amended: Where a statutory amendment replaces the applicable offense provisions but preserves the material content of the offense, the principle of the milder law does not require application of the new law if there is no relevant discontinuity of wrongdoing. For completed conduct, the law in force at the time of completion remains decisive unless the new provisions alter the substantive assessment of the act in a way that is favorable to the accused. A mere renumbering or restructuring of the offense catalogue, without material change in elements or protected legal interest, does not interrupt Unrechtskontinuität (consid. addendum).

18/9095, S. 32 ff.).

Question juridique clé

Whether the revisions against the LG Hechingen judgment were well-founded.

Solution extraite

The revisions were unfounded and were dismissed.

Motifs extraits

The Federal Court found no error warranting appellate relief and rejected the appeals under the criminal procedure rules governing manifestly unfounded revisions.

Question juridique clé

Which version of the human trafficking provisions applied after the 2016 amendment for conduct completed before the new law entered into force.

Solution extraite

The prior provisions used by the trial court remained applicable because the amendment preserved the necessary continuity of wrongful conduct under Article 2(3) StGB.

Motifs extraits

Although §§ 232 to 233b StGB were restructured by the 11 October 2016 amendment, the earlier § 232(1) sentence 1 alternative 1 and § 232(4) no. 1 StGB were replaced by § 232a(1) no. 1 and § 232a(3) StGB without any material change relevant to the offense elements here.
