On an inter-senate request in criminal cassation proceedings, the 5th Criminal Senate of the Federal Court of Justice held that the intended decision of the 3rd Criminal Senate was not contrary to its own prior case law. The Senate further declared that it no longer adheres to any earlier diverging case law, as set out in the request order.
