Résumé

The Federal Labour Court partially upheld the claimant’s revision in a labour dispute about substitute leave for 2012. It set aside the appellate judgment in part and amended the first-instance judgment in part. The defendant was ordered to grant the claimant three days of substitute leave for 2012. The claimant succeeded only partially overall and therefore had to bear three quarters of the costs, while the defendant had to bear one quarter.

Substitute leave claim in employment law; partial success on appeal permits partial amendment of the lower judgments and proportionate allocation of costs. Where the revision is only partly successful, the Federal Labour Court grants the claim only to the extent justified and adjusts the cost order accordingly; the remainder of the appeal is dismissed. The operative part may thus combine partial annulment of the appellate judgment, partial amendment of the first-instance judgment, and a concrete award of substitute leave (consid. tenor).

Tenor

  1. Auf die Revision der Klägerin wird unter Zurückweisung der Revision im Übrigen das Urteil des Hessischen Landesarbeitsgerichts vom 9. Mai 2014 - 3 Sa 687/13 - teilweise aufgehoben.

  2. Auf die Berufung der Klägerin wird unter Zurückweisung der Berufung im Übrigen das Urteil des Arbeitsgerichts Gießen vom 22. März 2013 - 10 Ca 361/12 - teilweise abgeändert.

Die Beklagte wird verurteilt, der Klägerin für Urlaub aus dem Jahr 2012 drei Tage Ersatzurlaub zu gewähren.

  1. Die Klägerin hat die Kosten des Rechtsstreits zu 3/4 zu tragen, die Beklagte zu 1/4.

Sonstige Leitsätze
