The Federal Labour Court allowed the plaintiff's revision, set aside the judgment of the Landesarbeitsgericht Niedersachsen and amended the judgment of the Arbeitsgericht Nienburg. The defendant was ordered to pay the plaintiff EUR 429.00 gross plus interest at five percentage points above the base rate from 2012-08-05. The defendant was also ordered to bear the costs. The decision was issued without statement of facts or reasons because the parties had waived them.
§ 313a Abs. 1 ZPO; waiver of statement of facts and reasons: where the parties waive the statement of facts and the reasons, the court may decide without setting them out. In such a case the operative part remains fully reviewable, but the judgment contains only the dispositive ruling. If the revision is successful, the Federal Labour Court may set aside the appellate judgment and, if the matter is ready for decision, amend the first-instance judgment itself and grant the asserted payment claim, including ancillary interest and costs.

Auf die Revision des Klägers wird das Urteil des Landesarbeitsgerichts Niedersachsen vom 5. August 2013 - 10 Sa 37/13 - aufgehoben.
Auf die Berufung des Klägers wird das Urteil des Arbeitsgerichts Nienburg vom 22. November 2012 - 2 Ca 308/12 - abgeändert.
Die Beklagte wird verurteilt, an den Kläger 429,00 Euro brutto nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 5. August 2012 zu zahlen.
Die Beklagte hat die Kosten des Rechtsstreits zu tragen.
