Résumé

The Federal Labour Court dismissed the plaintiff's revision against the judgment of the Rhineland-Palatinate Regional Labour Court. The court did not overturn the lower-court decision. The plaintiff was ordered to bear the costs of the revision. The decision was issued without findings of fact or reasons, as the parties had waived them under § 313a(1) ZPO.

§ 313a Abs. 1 ZPO; waiver of findings of fact and reasons does not affect the validity of the judgment; if the revision is unsuccessful, it is to be dismissed and the appellant bears the costs of the revision proceedings. The court may render a reasoned judgment in abbreviated form where the parties have waived the statement of facts and reasons; the absence of a full statement of reasons is permissible in such constellations.
