The Federal Labour Court dismissed the plaintiff's revision against the judgment of the Hessian LAG. The only operative consequences were dismissal of the revision and allocation of its costs to the plaintiff.
§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1 ZPO; § 313a Abs. 1 Satz 2 ZPO — If the parties waive findings of fact and reasons in view of a parallel proceeding, the court may render a judgment without factual findings and reasons. The waiver is effective even in revision proceedings; the dismissal of the revision and the consequential cost order remain unaffected by the absence of reasons.
