The Federal Labour Court dismissed the plaintiff's revision against the judgment of the Hessian Regional Labour Court. The decision was issued in an employment law matter reviewed by the 4th Senate. In light of a parallel proceeding, the parties waived findings of fact and reasons. The court therefore left the appellate judgment undisturbed and ordered the plaintiff to bear the costs of the revision.
§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1 ZPO; § 313a Abs. 1 Satz 2 ZPO: If the parties waive findings of fact and reasons in view of a parallel proceeding, the Federal Labour Court may decide the revision without full written reasons; where the revision is unsuccessful, it is to be dismissed and the revising party bears the costs. The waiver in connection with a parallel case permits a shortened form of judgment (consid. 1).
