Résumé

In this labor-law revision, the Federal Labour Court set aside the judgment of the Saxon Regional Labour Court and rejected the defendant’s appeal against the Bautzen Labour Court judgment. The decision was issued without findings of fact or reasons because the parties had waived them under Section 313a ZPO. The defendant was ordered to bear the costs of the appeal and revision.

§ 313a ZPO; waiver of findings of fact and reasons; where the parties waive findings of fact and reasons, the Federal Labour Court may dispose of the revision by operative part only. If the revision is upheld, the appellate judgment is set aside and, where appropriate, the opponent’s appeal against the first-instance judgment is dismissed; the costs of the appeal and revision may be imposed on the losing party by the operative part alone.

Tenor

Auf die Revision des Klägers wird das Urteil des Sächsischen Landesarbeitsgerichts vom 21. September 2011 - 2 Sa 715/10 - aufgehoben.
Die Berufung der Beklagten gegen das Urteil des Arbeitsgerichts Bautzen vom 20. Oktober 2010 - 1 Ca 1065/10 - wird zurückgewiesen.
Die Kosten der Berufung und der Revision hat die Beklagte zu tragen.

Sonstige Leitsätze
