The Federal Labor Court dismissed the defendant’s revision and only partially amended the operative part of the lower-court judgments. Die Beklagte ist verpflichtet, dem Kläger für die Zeit vom 1. Juli 2007 bis zum 31. August 2008 eine monatliche Leistungszulage in einer Gesamthöhe von 598,73 Euro brutto abzüglich bereits geleisteter Zahlungen zu zahlen und diese Leistungszulage bei der Berechnung des weiterzuzahlenden Monatsentgelts (§ 16 EMTV) , des zusätzlichen Urlaubsgelds (§ 14 Nr. 1 und Nr. 2 EMTV) sowie der Sonderzahlung (§ 2 Nr. 2.2 ETV 13. Monatseinkommen) zu berücksichtigen.
