The Federal Labour Court decided a revision in an employment wage dispute. § 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1, § 313a Abs. 1 Satz 2 ZPO: Where the parties waive findings of fact and reasons in view of a lead parallel case, the Federal Labour Court may dispose of the revision accordingly. An appeal is inadmissible insofar as it is directed against a declaratory ruling on a precisely delimited wage entitlement period when the procedural prerequisites for appellate review are lacking. The Court may therefore partly set aside the appellate judgment and reject the appeal as inadmissible; costs follow the outcome of the revision proceedings.

Auf die Revision des beklagten Landes wird das Urteil des Hessischen Landesarbeitsgerichts vom 6. Januar 2010 - 2 Sa 1126/09 - teilweise aufgehoben.
Die Berufung des Klägers gegen das Urteil des Arbeitsgerichts Marburg vom 17. April 2009 - 2 Ca 102/09 - wird im Umfang der Feststellung, dass das beklagte Land verpflichtet ist, dem Kläger Grundvergütung nach der Vergütungsgruppe II a der Anlage 1a zum BAT nach der höchsten Lebensaltersstufe dieser Vergütungsgruppe für die Zeit vom 1. Juni 2008 bis zum 31. Oktober 2008 zu zahlen, als unzulässig verworfen.
Der Kläger hat die Kosten der Berufung und der Revision zu tragen.
