The Federal Labour Court heard the defendant Land's revision in a wage dispute concerning the plaintiff's claim to base salary at the highest age step of pay group V b S for the period from 1 May 2008 to 31 December 2009. The Court partially set aside the judgment of the Hessian Labour Court and held that, insofar as the plaintiff sought a declaration on this wage entitlement, her appeal against the Marburg Labour Court judgment was inadmissible. The plaintiff was ordered to bear the costs of the appeal and revision proceedings. The parties waived a statement of facts and reasons because of a leading parallel case.

§ 72 Abs. 5 ArbGG; § 555 Abs. 1 Satz 1, § 313a Abs. 1 Satz 2 ZPO: In a leading parallel case, the parties may waive statement of facts and reasons; the court may decide accordingly. Where the appeal is directed only against a declaratory ruling on a wage entitlement, admissibility must be assessed autonomously for the challenged part of the judgment; if the admissibility requirements are lacking, the appeal is to be rejected as inadmissible in that extent. Costs of appeal and revision follow the outcome of the proceedings.

Tenor

  1. Auf die Revision des beklagten Landes wird das Urteil des Hessischen Landesarbeitsgerichts vom 6. Januar 2010 - 2 Sa 1122/09 - teilweise aufgehoben.

  2. Die Berufung der Klägerin gegen das Urteil des Arbeitsgerichts Marburg vom 17. April 2009 - 2 Ca 86/09 - wird im Umfang der Feststellung, dass das beklagte Land verpflichtet ist, der Klägerin Grundvergütung nach der Vergütungsgruppe V b S der Anlage 1a zum BAT nach der höchsten Lebensaltersstufe dieser Vergütungsgruppe für die Zeit vom 1. Mai 2008 bis zum 31. Dezember 2009 zu zahlen, als unzulässig verworfen.

  3. Die Klägerin hat die Kosten der Berufung und der Revision zu tragen.
