The Federal Labour Court partially upheld the defendant state's revision in a BAT remuneration dispute. It set aside the Hessian LAG judgment in part and held that the plaintiff's appeal was inadmissible to the extent it sought a declaration that the state had to pay base salary under Vergütungsgruppe IV b at the highest age step for June to August 2008. Soweit die angefochtene Entscheidung einen unzulässigen Berufungsgegenstand betrifft, ist die Berufung insoweit als unzulässig zu verwerfen; die Kostenentscheidung folgt dem Obsiegen und Unterliegen im Rechtsmittelzug.

Tenor

  1. Auf die Revision des beklagten Landes wird das Urteil des Hessischen Landesarbeitsgerichts vom 6. Januar 2010 - 2 Sa 1294/09 - teilweise aufgehoben.

  2. Die Berufung des Klägers gegen das Urteil des Arbeitsgerichts Gießen vom 16. April 2009 - 1 Ca 55/09 - wird im Umfang der Feststellung, dass das beklagte Land verpflichtet ist, dem Kläger Grundvergütung nach der Vergütungsgruppe IV b der Anlage 1a zum BAT nach der höchsten Lebensaltersstufe dieser Vergütungsgruppe für die Zeit vom 1. Juni 2008 bis zum 31. August 2008 zu zahlen, als unzulässig verworfen.

  3. Der Kläger hat die Kosten der Berufung und der Revision zu tragen.
