In a labour law appeal concerning a fixed-term employment dispute, the defendant acknowledged the claim before the Federal Labour Court. The Court therefore rendered an acknowledgment judgment without setting out facts or reasons. It set aside the Berlin-Brandenburg Higher Labour Court's judgment, rejected the defendant's appeal against the Berlin Labour Court judgment, and ordered the defendant to bear the costs of the appeal and revision.

The acknowledgment judgment replaces a full reasoned judgment and may dispose of the appellate proceedings accordingly; the acknowledging party bears the costs resulting from the appeal and revision where ordered in the dispositive part.

Tenor

Auf die Revision des Klägers wird das Urteil des Landesarbeitsgerichts Berlin-Brandenburg vom 26. September 2008 - 8 Sa 1115/08 - aufgehoben.
Die Berufung der Beklagten gegen das Urteil des Arbeitsgerichts Berlin vom 28. März 2008 - 58 Ca 942/08 - wird zurückgewiesen.
Die Beklagte hat auch die Kosten der Berufung und der Revision zu tragen.

Sonstige Leitsätze

Von der Darstellung des Tatbestandes und der Entscheidungsgründe wird abgesehen (§ 313b Abs. 1 Satz 1 ZPO). Die Beklagte hat den Klageanspruch anerkannt.
