The Federal Court granted the defendant reinstatement into the prior state after the deadline for filing the revision reasons had been missed, following the Federal Public Prosecutor General's submission. The revision itself was then dismissed as unfounded. The court held that the procedural complaint against the refusal to examine seized exhibits for blood, DNA, and gunshot residue was inadmissibly raised because the exhibit schedules were not filed. Without those schedules, the court could not identify the objects or assess their evidentiary significance. The defendant was ordered to bear the costs of reinstatement and the revision proceedings, including the necessary expenses of the co-plaintiffs.
§ 344 Abs. 2 Satz 2 StPO; procedural complaint against refusal to take evidence from exhibits designated only by exhibit numbers; where the rejected request identifies the objects solely by exhibit numbers, the exhibit schedules must also be submitted so that the reviewing court can ascertain the objects and their evidentiary relevance. Absent such submissions, the complaint is inadmissible (consid. related to the admissibility of the Rüge). Reinstatement into the prior state after missing the revision-reasons deadline may be granted where the statutory requirements are met and the court follows the prosecutor general’s submission.

Die Kosten der Wiedereinsetzung trägt der Angeklagte.
Der Beschwerdeführer hat die Kosten seines Rechtsmittels und die den Nebenklägern im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.
Ergänzend bemerkt der Senat:
Die Rüge, das Landgericht habe bei der Ablehnung des Antrags auf Untersuchung von Asservaten auf „Spuren von Blut und DNA und Schmauchspuren“ gegen § 244 Abs. 3 Satz 2 StPO verstoßen, ist nicht zulässig erhoben (§ 344 Abs. 2 Satz 2 StPO). In dem abgelehnten Antrag wurden die zu untersuchenden Gegenstände anhand von Asservatennummern bezeichnet. Es wäre daher erforderlich gewesen, auch die Asservatenverzeichnisse vorzulegen. Dies ist nicht geschehen. Der Senat kann deshalb nicht prüfen, um welche Gegenstände es sich im Einzelnen handelt und welche Beweisbedeutung sie haben.
