Résumé Omnilex

The Federal Court of Justice decided on a complaint against the denial of leave to appeal in an eviction dispute concerning residential premises leased for an indefinite term. It held that the complaint was admissible because the dispute value exceeded EUR 20,000: under Sections 8 and 9 ZPO, the value is 3.5 times the annual net rent, which at EUR 750 per month resulted in EUR 31,500. On the merits, however, the complaint was unfounded because the case raised no question of fundamental importance and did not require a revision decision for the development of the law or the maintenance of uniform case law. The plaintiffs had to bear the costs.

Regeste Omnilex

§§ 8, 9 ZPO; § 26 Nr. 8 EGZPO; § 543 Abs. 2 Satz 1 ZPO; complaint against denial of leave to appeal in an action for eviction of residential premises: the value of the complaint is, in the case of an action for surrender of a dwelling rented for an indefinite period, generally determined at 3.5 times the annual net rent. The admissibility threshold under § 26 No. 8 EGZPO is thus met if this calculation exceeds EUR 20,000. If none of the grounds for leave to appeal under § 543(2) sentence 1 ZPO is established, the complaint is unfounded; a short-form reasoning pursuant to § 544(4) sentence 2 ZPO may be dispensed with.

2 ZPO abgesehen.

Question juridique clé

Whether the value of the subject matter of the complaint exceeded EUR 20,000 and the complaint was admissible.

Solution extraite

Yes. In an eviction action concerning an indefinite residential lease, the dispute value is calculated at 3.5 times the annual net rent; here it was EUR 31,500.

Motifs extraits

For a claim for eviction of a dwelling leased for an indefinite term, the value of the complaint is determined under Sections 8 and 9 ZPO by 3.5 times the annual net rent. With a monthly net rent of EUR 750, the amount in dispute exceeded the statutory threshold under Section 26 No. 8 EGZPO.

Question juridique clé

Whether leave to appeal had to be granted because of fundamental importance, development of the law, or uniformity of case law.

Solution extraite

No. None of the grounds for leave to appeal under Section 543(2) sentence 1 ZPO were present.

Motifs extraits

The court saw no need for a decision of the court of revision and therefore gave no detailed reasons under Section 544(4) sentence 2 ZPO.
