The 4th Criminal Senate answered a referral from the 2nd Criminal Senate concerning whether the offender’s personal and economic circumstances may influence the assessment of pain-and-suffering compensation in criminal proceedings. The Senate joined the Great Senate for Civil Matters, expressly relying on the 1955 and 2015 decisions, and stated that it would no longer follow its own earlier broader approach from 1996 and 2014. No individual case outcome was decided; the ruling resolves the legal question only.
§ 253 Abs. 2 BGB in conjunction with § 40 Abs. 1 StPO; assessment of pain-and-suffering compensation in criminal proceedings does not permit consideration of the offender’s personal and financial circumstances. The 4th Criminal Senate aligns itself with the case law of the Great Senate for Civil Matters and abandons its former broader view (consid. tenor). The compensation serves to balance the non-pecuniary harm; it is not to be adjusted by the offender’s means. Earlier contrary Senate case law is expressly not maintained.

Beantwortung der Anfrage des 2. Strafsenats zur Berücksichtigung der persönlichen und wirtschaftlichen Verhältnisse des Täters im Rahmen der Zumessung eines Schmerzensgeldes
Der 4. Strafsenat schließt sich der Rechtsauffassung des Großen Senats für Zivilsachen in den Beschlüssen vom 6. Juli 1955 - GSZ 1/55 und vom 12. Oktober 2015 - GSZ 1/14 an. An seiner eigenen, weiter gehenden Rechtsprechung (vgl. BGH, Beschlüsse vom 14. Mai 1996 - 4 StR 174/96, und vom 18. Juni 2014 - 4 StR 217/14) hält er nicht fest.
