The Federal Court of Justice partly upheld the defendant’s revision against the Traunstein Regional Court’s conviction for attempted murder, dangerous bodily harm, and threat. It held that the threat was consumed by the attempted felony when the threatened act coincides with the attempt. The conviction was therefore amended to remove the threat count. The sentence of seven years and six months was left unchanged because the error did not affect sentencing. The defendant had to pay the costs of the appeal and the private complainant’s necessary expenses.

Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Traunstein vom 25. Juni 2015 wird mit der Maßgabe als unbegründet verworfen, dass die tateinheitliche Verurteilung wegen Bedrohung entfällt.

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die der Nebenklägerin im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Gründe

1 Das Landgericht hat den Angeklagten wegen versuchten Mordes in Tateinheit mit gefährlicher Körperverletzung und Bedrohung zu einer Freiheitsstrafe von sieben Jahren und sechs Monaten verurteilt.

2 Die auf die nicht ausgeführte und daher unzulässige Verfahrensrüge und die Sachrüge gestützte Revision des Angeklagten erzielt den aus der Beschlussformel ersichtlichen Teilerfolg (§ 349 Abs. 4 StPO); im Übrigen ist sie mit Ausnahme der konkurrenzrechtlichen Beurteilung der Taten unbegründet im Sinne des § 349 Abs. 2 StPO.

3 Das Landgericht hat übersehen, dass der Tatbestand der Bedrohung von dem versuchten Verbrechen konsumiert wird, wenn die angedrohte Tat mit dem Versuch oder der Vollendung des angedrohten Verbrechens zusammentrifft (vgl. BGH, Urteil vom 1. Februar 2005 - 1 StR 327/04, NJW 2005, 1203, 1205; Schluckebier in LK, 12. Aufl., § 241 Rn. 31; Sinn in MünchKomm StGB, 2. Aufl., § 241 Rn. 17; Schönke/Schröder/Eser/Eisele, StGB, 29. Aufl., § 241 Rn.16). Daher war der Schuldspruch dahingehend abzuändern, dass die Verurteilung wegen tateinheitlich begangener Bedrohung entfällt.

4 Angesichts des Umstandes, dass die Strafkammer bei der Bemessung der Einzelstrafe von einer tateinheitlichen Begehung von versuchtem Mord, gefährlicher Körperverletzung und Bedrohung ausgegangen ist, aber der versuchte Mord und die gefährliche Körperverletzung den alles überlagernden Schwerpunkt dieses Tatgeschehens ausmachen, kann der Senat ausschließen, dass die fehlerhafte konkurrenzrechtliche Beurteilung die Bemessung der Strafe beeinflusst hat.

5 Der nur geringe Teilerfolg der Revision rechtfertigt es nicht, den Angeklagten teilweise von den durch sein Rechtsmittel entstandenen Kosten und Auslagen freizustellen (§ 473 Abs. 1 und 4 StPO).
