The Federal Court of Justice dismissed the defendant’s revision against the Regional Court of Stendal judgment as unfounded. The court held that no legal error adverse to the defendant was shown. It left open whether the case law denying present-evidence status to photocopies of documents also applies to a printout of an otherwise only digitally stored email. In any event, the conviction did not rest on the arguably defective reasoning used to reject the defense’s evidentiary motion. The defendant was ordered to bear the costs of the appeal and the private complainant’s necessary expenses in the revision proceedings.

Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Stendal vom 11. Mai 2015 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat.

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die der Nebenklägerin im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Ergänzend bemerkt der Senat:

Es kann dahinstehen, ob die Rechtsprechung, wonach der Ablichtung einer Urkunde nicht die Qualität eines präsenten Beweismittels im Sinne des § 245 Abs. 2 StPO zukommt (vgl. BGH, Beschluss vom 22. Juni 1994 - 3 StR 646/93, BGHR StPO § 245 Beweismittel 1; zweifelnd BGH, Urteil vom 6. September 2011 - 1 StR 633/10, wistra 2012, 29, 33), auf den Fall zu übertragen ist, in dem sich - wie hier - der Beweisantrag auf die Verlesung des Ausdrucks einer ansonsten nur digital vorhandenen E-Mail bezieht. Jedenfalls beruht das angefochtene Urteil aus den Gründen der Antragsschrift des Generalbundesanwalts vom 5. August 2015 auf der für sich genommen rechtlich bedenklichen Begründung des Ablehnungsbeschlusses nicht.
