Tenor

Es wird festgestellt, dass die Reise des Antragstellers zu der Hauptverhandlung vor dem Senat am 28. April 2015 erforderlich ist.

Gründe

1 Der Antragsteller ist beigeordneter Nebenklägervertreter (§ 397a StPO) des durch die verfahrensgegenständlichen Straftaten geschädigten Kindes L. . Er hat mit am 2. April 2015 eingegangenen Schriftsatz beantragt festzustellen, dass seine Reise zu der am 28. April 2015 vor dem Senat stattfindenden Hauptverhandlung über die Revision der Staatsanwaltschaft gegen das Urteil des Landgerichts München II vom 16. Juni 2014 erforderlich ist.

2 Dem Antrag war gemäß § 46 Abs. 2 Satz 1 RVG zu entsprechen. Die Teilnahme des Antragstellers an der Revisionshauptverhandlung, in der über die Revision der Staatsanwaltschaft gegen das Unterbleiben der Anordnung der Sicherungsverwahrung gegen den Angeklagten zu entscheiden ist, ist zur Wahrnehmung der Interessen des Nebenklägers und seiner Rechte (§ 397 Abs. 1 StPO) geboten. Dass der Nebenkläger die Nichtanordnung der Sicherungsverwahrung nicht isoliert rügen könnte (§ 400 Abs. 1 StPO), steht nicht entgegen. Bei einem zulässigen Rechtsmittel der Staatsanwaltschaft bleiben die Beteiligungsrechte des Nebenklägers aus § 397 StPO bestehen. Dies begründet die Notwendigkeit der Reise des Antragstellers, der in die Strafsache aufgrund seiner Beiordnung bereits in erster Instanz eingearbeitet ist.

3 Es wird darauf verwiesen, dass über die Angemessenheit von Auslagen erst bei der Festsetzung der Vergütung zu entscheiden ist (vgl. BFH, Beschluss vom 10. August 2007 - III S 26/07 Rn. 6).
