The Federal Court dismissed the defendant’s nonadmission complaint in a civil dispute over the value of a negative declaratory action. It held that the opponent’s claim for reimbursement of reminder costs does not increase the value because such costs are ancillary claims under Section 4 ZPO. The dispute value therefore remained below the EUR 20,000 threshold required for the complaint. The court also set the value of the complaint proceedings at EUR 20,000 and ordered the defendant to bear the costs.

Tenor

Die Beschwerde gegen die Nichtzulassung der Revision in dem Urteil des 6. Zivilsenats des Oberlandesgerichts Frankfurt am Main vom 10. April 2014 wird auf Kosten des Beklagten zurückgewiesen, weil der Wert der vom Beklagten mit der Revision geltend zu machenden Beschwer 20.000 € nicht übersteigt (§ 26 Nr. 8 EGZPO, §§ 544, 97 Abs. 1 ZPO).

Der Wert des Beschwerdeverfahrens wird auf 20.000 € festgesetzt.

Gründe

1 Das Berufungsgericht hat den Streitwert zwar auf 20.859,80 € festgesetzt, weil es werterhöhend berücksichtigt hat, dass sich die Klägerin mit ihrer negativen Feststellungsklage auch gegen einen Anspruch des Beklagten auf Erstattung von Abmahnkosten in Höhe von 859,80 € wendet. Das ist aber unrichtig. Die Abmahnkosten bleiben als Nebenforderungen gemäß § 4 ZPO außer Betracht. Der Wert der negativen Feststellungsklage entspricht dem Wert der Leistungsklage umgekehrten Rubrums (vgl. OLG Karlsruhe, Beschluss vom 11. April 2005 - 17 W 21/05, juris).

2 Die Ausführungen des Beklagten im Schriftsatz vom 2. März 2015 geben keinen Anlass, seine Beschwer durch das Berufungsurteil auf über 20.000 € festzusetzen.
