The Federal Court of Justice rejected the defendant’s revision against a judgment of the Regional Court of Braunschweig. The Senate held that, for § 95(3) No. 1a AMG, the health of a large number of people is endangered where 20 persons are affected. It also found no basis for lesser-case treatment in counts 22–26, 28, 30 and 31, nor for excluding the ordinary sentencing range in counts 3–21, given the scope and gravity of the offenses. The defendant was ordered to bear the costs of the remedy.

Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Braunschweig vom 10. Juli 2014 wird nach § 349 Abs. 2 StPO als unbegründet verworfen.

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Ergänzend bemerkt der Senat:

Zu Recht ist das Landgericht davon ausgegangen, dass vorliegend jedenfalls dann die Gesundheit einer großen Zahl von Menschen im Sinne des § 95 Abs. 3 Nr. 1a AMG gefährdet ist, wenn 20 Personen betroffen sind.

Die Annahme minder schwerer Fälle in den Fällen 22 bis 26, 28, 30, 31 lag ebenso fern wie die Nichtanwendung des Normalstrafrahmens in den Fällen 3 bis 21 angesichts des Umfangs und des Gewichts der abgeurteilten Taten.
