The Federal Court of Justice rejected the defendant's revision against the Düsseldorf Regional Court judgment. The defendant had argued that the criminal chamber should have reconsidered its bench composition after issuing a warning about possible placement in a psychiatric hospital. The Senate held that, once the main hearing has begun, the trial must be continued in the composition originally decided; a new composition decision is only possible after remittal or suspension of the hearing. The revision was therefore unfounded, and the defendant had to pay the costs of the remedy and the necessary expenses of the private accessory prosecutors.

A renewed composition decision is not permitted merely because the evidentiary situation changes or a warning under § 265 StPO / possible measure under § 63 StGB is given. Under § 76 Abs. 5 GVG, a new composition decision is admissible only if the case has been remitted by the appellate court or the main hearing has been suspended; otherwise the original bench remains binding (cf. consid. on the systematic interpretation and legislative intent).

Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Düsseldorf vom 28. März 2012 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die den Nebenklägern im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Zu der Rüge einer Verletzung des § 76 Abs. 2 GVG bemerkt der Senat:

Die Rüge bleibt auch insoweit ohne Erfolg, als sie beanstandet, die Strafkammer habe nicht erneut ihre Besetzung mit zwei Berufsrichtern geprüft und eine Besetzung mit drei Berufsrichtern beschlossen, nachdem sie in der Hauptverhandlung einen Hinweis auf die mögliche Anordnung einer Unterbringung in einem psychiatrischen Krankenhaus (§ 63 StGB) gegeben hatte. Sowohl nach Wortlaut und Systematik des § 76 GVG als auch nach der Intention des Gesetzgebers (vgl. BT-Drucks. 17/6905 S. 10, 12) ist die begonnene Hauptverhandlung in der ursprünglich beschlossenen Besetzung zu Ende zu führen (vgl. entsprechend zu § 76 Abs. 2 GVG aF BGH, Beschluss vom 13. September 2011 - 5 StR 189/11, StraFo 2011, 517 mwN). Ein erneuter Beschluss über die Kammerbesetzung ist nach Beginn der Hauptverhandlung gemäß § 76 Abs. 5 GVG nur unter den hier nicht gegebenen Voraussetzungen möglich, dass die Sache vom Revisionsgericht zurückverwiesen oder die Hauptverhandlung ausgesetzt worden ist.
