The Federal Court of Justice discontinued the criminal proceedings because the accused had died, which created an absolute procedural obstacle under Section 206a(1) StPO. The challenged judgment, including its costs ruling, became moot without needing formal annulment. On costs, the court applied Section 467(1) and (3) sentence 2 no. 2 StPO, ordered the state treasury to bear the procedural costs, but declined to order reimbursement of the accused's necessary expenses; the necessary expenses of the private prosecutors were not awarded.

Tenor

Das Verfahren wird eingestellt.

Die Staatskasse trägt die Kosten des Verfahrens. Es wird jedoch davon abgesehen, ihr die notwendigen Auslagen des Angeklagten aufzuerlegen.

Gründe

1 Der Angeklagte ist in der Zwischenzeit verstorben. Das Verfahren ist daher gemäß § 206a Abs. 1 StPO wegen eines Verfahrenshindernisses einzustellen (vgl. Senatsbeschluss vom 8. Juni 1999 – 4 StR 595/97, BGHSt 45, 108, 111 f.). Das angefochtene Urteil – auch dessen Kostenentscheidung – ist damit gegenstandslos, ohne dass es einer Aufhebung bedarf (Senatsbeschluss vom 5. August 1999 – 4 StR 640/98, wistra 1999, 426; Meyer-Goßner, StPO, 55. Aufl., § 206a Rn. 8).

2 Die Kosten- und Auslagenentscheidung beruht auf § 467 Abs. 1 und Abs. 3 Satz 2 Nr. 2 StPO (BGH, Beschluss vom 2. Oktober 2008 – 1 StR 388/08, NStZ-RR 2009, 21). Die Erstattung der den Nebenklägern entstandenen notwendigen Auslagen kommt bei Einstellung wegen eines Verfahrenshindernisses nicht in Betracht (Löwe-Rosenberg/Hilger, StPO, 26. Aufl., § 472 Rn. 4); in der Beschlussformel ist dies nicht besonders auszusprechen.
