Tenor

Der Senat beabsichtigt, die zugelassene Revision des Klägers gegen das Urteil der 3. Zivilkammer des Landgerichts Freiburg vom 21. Juli 2011 durch einstimmigen Beschluss nach § 552a ZPO zurückzuweisen.

Gründe

1 Ein Grund für die Zulassung der Revision liegt nicht vor (§ 552a Satz 1, § 543 Abs. 2 Satz 1 Nr. 1, Nr. 2 ZPO). Die Rechtssache hat weder grundsätzliche Bedeutung noch ist eine Entscheidung des Revisionsgerichts zur Fortbildung des Rechts oder zur Sicherung einer einheitlichen Rechtsprechung erforderlich.

2 1. Die Frage, ob der Erwerber einer Genossenschaftswohnung an den im Mietvertrag vereinbarten Ausschluss der ordentlichen Kündigung auch dann gebunden ist, wenn die im Nutzungsvertrag vorausgesetzte Mitgliedschaft in der Genossenschaft infolge der Insolvenz der Genossenschaft erloschen ist, ist nicht grundsätzlicher Natur. Es versteht sich vielmehr von selbst, dass die im ursprünglichen Mietvertrag mit der Genossenschaft vorausgesetzte Mitgliedschaft des Mieters in der Genossenschaft nach der Veräußerung der Wohnung und dem Eintritt des Erwerbers in den Mietvertrag keine Bedeutung mehr für das Mietverhältnis hat.

3 2. Die Revision hat aus den zutreffenden Gründen des Berufungsurteils auch keine Aussicht auf Erfolg.

4 3. Es besteht Gelegenheit zur Stellungnahme binnen drei Wochen ab Zustellung dieses Beschlusses.
