Nachträgliche Anordnung der Sicherungsverwahrung: Vertrauensschutz wegen Erledigterklärung der Unterbringung in einem psychiatrischen Krankenhaus

Tenor

Die Revision des Betroffenen gegen das Urteil des Landgerichts Erfurt vom 1. August 2011 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Betroffenen ergeben hat.

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Ergänzend bemerkt der Senat:

Das Landgericht hat zu Recht im Hinblick auf den von der Staatsanwaltschaft erst nach Beendigung der Maßregel nach § 63 StGB gestellten Antrag auf nachträgliche Anordnung der Sicherungsverwahrung gemäß § 275a Abs. 1 Satz 3-5 StPO i.V.m. § 66b Abs.3 StGB a.F. ein Verfahrenshindernis wegen Vertrauensschutzes verneint. Dabei hat das Landgericht zutreffend - dem Beschluss des Thüringer Oberlandesgerichts vom 11. Februar 2011 (1 Ws 528/10) folgend - die frühere Rechtsprechung des Senats zum Zeitpunkt der Antragstellung bei nachträglicher Anordnung der Sicherungsverwahrung nach § 66b Abs. 1 u. 2 StGB a.F. für nicht übertragbar gehalten auf die Fälle einer Erledigung der Unterbringung in einem psychiatrischen Krankenhaus nach § 66b Abs. 3 StGB a.F. i.V.m. § 67d Abs. 6 StGB. Der Senat hatte für die nachträgliche Anordnung der Sicherungsverwahrung gemäß § 66b Abs. 1 u. 2 StGB a.F. ein Verfahrenshindernis angenommen, wenn der Antrag erst nach Beendigung der Strafvollstreckung im Ausgangsverfahren gestellt wurde (Beschluss vom 26. Mai 2010 - 2 StR 263/10, StV 2010, 509). Demgegenüber setzt in den Fällen einer nachträglichen Anordnung der Sicherungsverwahrung nach § 66b Abs. 3 StGB a.F. (nunmehr: § 66b Satz 1 StGB n.F.) der eindeutige Wortlaut der Verfahrensvorschrift des § 275a Abs. 1 Satz 3 StPO voraus, dass bei Antragstellung eine Erklärung der Erledigung der Unterbringung und damit die diesbezügliche Anordnungsvoraussetzung des § 66b Abs. 3 StGB a.F. bereits vorliegt. Hier steht auch nicht die erstmalige Anordnung einer zeitlich nicht begrenzten freiheitsentziehenden Maßregel gegen einen zeitlich befristet in Haft befindlichen und daher auf das absehbare Strafvollzugsende vertrauenden Täter in Rede, sondern die Anordnung betrifft einen bereits zeitlich grundsätzlich unbegrenzt untergebrachten Verurteilten, dessen Gefährlichkeit für die Allgemeinheit schon bei seiner Unterbringung bekannt war. Letztlich geht es bei einer nachträglichen Anordnung der Sicherungsverwahrung nach § 66b Abs. 3 StGB a.F. (§ 66b Satz 1 StGB n.F.) nur um eine unter verschärften Anordnungsvoraussetzungen erfolgende Überweisung von einer Maßregel in eine andere, bei der sich eine Rückwirkungs- und Vertrauensschutzproblematik allenfalls in stark abgeschwächter Form stellt (vgl. BGH, Beschluss vom 7. Oktober 2008 - GSSt 1/08, BGHSt 52, 379, 391 Rn. 35).
