In an inter-senate reference concerning § 283 StGB, the 2nd Criminal Senate held that it agrees with the requesting 3rd Criminal Senate on the criminal liability of a GmbH managing director for bankruptcy offences. The Senate expressly abandoned its earlier opposing case law.
§ 283 StGB; liability of a GmbH managing director for bankruptcy offences; the 2nd Criminal Senate aligns itself with the requesting senate and abandons its previous contrary case law, thereby resolving the divergence in interpretation of the personal scope of bankruptcy offences.
