The BGH granted reinstatement because the application under § 234(1) ZPO was timely. On the merits, however, the hearing complaint failed: the absence of reasons in the refusal of legal aid for an intended non-admission appeal did not amount to a violation of the right to be heard, since final legal-aid decisions need not be reasoned and the reasoning duty for a refusal of non-admission appeal is limited.

Tenor

Dem Beklagten wird Wiedereinsetzung in den vorigen Stand gegen die Versäumung der Frist zur Erhebung der Anhörungsrüge gegen den Beschluss des Senats vom 7. April 2011 gewährt.

Die Anhörungsrüge des Beklagten gegen den Beschluss des Senats vom 7. April 2011 wird zurückgewiesen.

Gründe

1 1. Die Anhörungsrüge gemäß § 321a ZPO ist zulässig. Dem Beklagten ist nach Ablehnung seines Prozesskostenhilfegesuchs für die Erhebung einer Anhörungsrüge auf seinen rechtzeitig gestellten Antrag (§ 234 Abs. 1 ZPO) Wiedereinsetzung in den vorigen Stand zu gewähren. Die Frist des § 234 Abs. 1 Satz 2 ZPO ist gewahrt.

2 2. Die Anhörungsrüge ist jedoch unbegründet. Wie bereits im Senatsbeschluss vom 19. Mai 2011 ausgeführt, stellt das Fehlen einer Begründung der Zurückweisung des Prozesskostenhilfeantrags des Beklagten für eine beabsichtigte Nichtzulassungsbeschwerde keine Verletzung von Art. 103 Abs. 1 GG dar, da unanfechtbare Entscheidungen über Anträge auf Bewilligung von Prozesskostenhilfe keiner Begründung bedürfen. Im Übrigen bedarf auch die zurückweisende Entscheidung über eine Nichtzulassungsbeschwerde nur unter der hier nicht gegebenen Voraussetzung des § 544 Abs. 1 Satz 2 ZPO einer Begründung. Die Begründungspflicht für eine Entscheidung, mit der Prozesskostenhilfe für eine Nichtzulassungsbeschwerde versagt wird, geht darüber nicht hinaus.

3 Der Senat hat die vom Beklagten gegen das Berufungsurteil erhobenen Rügen sämtlich geprüft und schon aus Rechtsgründen für nicht durchgreifend erachtet. Dieses Prüfungsergebnis liegt seiner Entscheidung zugrunde.
