The Federal Court rejected the plaintiffs' complaint against the refusal of leave to appeal by the Hamburg Court of Appeal. It held that the case raised no fundamental question, the procedural complaints did not succeed, and further review was unnecessary. On the merits, the court referred to its later case law and stated that private providers' sports-betting, lottery, and casino offers were not unfair during the transition period between the Federal Constitutional Court's sports-betting decision and the entry into force of the Interstate Treaty on Gambling. The challenged stadium banner advertising for the 7 February 2007 match was therefore not unlawful. The plaintiffs were ordered to pay the costs.

Tenor

Die Beschwerde der Klägerinnen gegen die Nichtzulassung der Revision in dem Urteil des Hanseatischen Oberlandesgerichts Hamburg, 5. Zivilsenat, vom 8. April 2009 wird zurückgewiesen, weil die Rechtssache keine grundsätzliche Bedeutung hat, die auf die Verletzung von Verfahrensgrundrechten gestützten Rügen nicht durchgreifen und die Fortbildung des Rechts oder die Sicherung einer einheitlichen Rechtsprechung eine Entscheidung des Revisionsgerichts auch im Übrigen nicht erfordern (§ 543 Abs. 2 S. 1 ZPO).

Die Entscheidung des Berufungsgerichts stellt sich schon deshalb als richtig dar, weil nach der nach dem Berufungsurteil ergangenen Rechtsprechung des Senats das Angebot von Sportwetten, Lotterien und Kasinospielen durch private Anbieter auch während der Übergangszeit zwischen dem Sportwetten-Urteil des Bundesverfassungsgerichts vom 28. März 2006 (BVerfGE 115, 276) und dem Inkrafttreten des Glücksspielstaatsvertrags vom 1. Januar 2008 nicht wettbewerbswidrig war (vgl. BGH, Urteil vom 18. November 2010 - I ZR 156/07 Rn. 34 ff., juris). Damit fehlt es für den Zeitpunkt des Länderspiels am 7. Februar 2007 auch an der Wettbewerbswidrigkeit der von den Klägerinnen beanstandeten Bandenwerbung.

Von einer weiteren Begründung wird gemäß § 544 Abs. 4 S. 2, 2. Halbs. ZPO abgesehen.

Die Klägerinnen tragen die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
