Résumé Omnilex

The Federal Court of Justice rejected the plaintiff’s complaint against denial of leave to appeal. It held that the complaint did not satisfy the requirements of Section 543(2) ZPO because it did not show fundamental importance, a need for legal development, or the need to secure uniform case law. The Court also stated that forced inpatient treatment under a state psychiatric detention statute remains sovereign action even if performed in the closed ward of a municipal clinic. The plaintiff was ordered to bear the costs of the complaint proceedings.

Regeste Omnilex

§ 543 Abs. 2 S. 1 ZPO; non-admission complaint and requirements for leave to appeal; state-compulsory inpatient treatment in a closed municipal clinic ward as sovereign action. A complaint against denial of leave to appeal is inadmissible or unfounded where it merely disputes the merits without showing fundamental importance, need for legal development, or safeguarding of uniform case law. Compulsory treatment under a land psychiatric detention statute is performed hoheitlich even when organized within a municipal hospital; liability is therefore governed by § 839 Abs. 1 Satz 2 BGB in conjunction with Art. 34 GG, not by ordinary tort liability under § 823 Abs. 1 BGB.

Halbs. ZPO abgesehen.

Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
