Tenor

Die Revision des Beklagten und der Drittwiderklägerin gegen das Urteil des 11. Zivilsenats des Schleswig-Holsteinischen Oberlandesgerichts vom 9. Dezember 2008 wird nach § 552 a ZPO i.V.m. § 522 Abs. 2 Satz 2 und 3 ZPO auf Kosten des Beklagten und der Drittwiderklägerin zurückgewiesen. Zur Begründung wird auf den Hinweisbeschluss des Senats vom 23. November 2009 Bezug genommen. Die Stellungnahmen des Beklagten und der Drittwiderklägerin vom 26. März 2010 und vom 28. Juli 2010 geben zu einer abweichenden Beurteilung keinen Anlass.

Hinsichtlich der vom Beklagten mit Schriftsatz vom 8. Juni 2010 erklärten Erledigung des noch anhängigen Revisionsverfahrens fehlt es im Übrigen an einem erledigenden Ereignis sowohl im Hinblick auf die Hauptsache als auch hinsichtlich des Revisionsverfahrens.

Der Beklagte und die Drittwiderklägerin tragen aus den im Tenor des Senatsbeschlusses vom 23. November 2009 dargelegten Gründen auch die Kosten des Verfahrens der Nichtzulassungsbeschwerde (§ 97 ZPO).
