Résumé Omnilex

The Bundesgerichtshof rejected the plaintiff's complaint against the refusal to admit a revision in a partnership dispute concerning pension and buyout provisions for departing partners. It found no statutory basis for admitting the revision under Section 543(2) ZPO. The court also noted that the appellate court was likely correct in treating the pension clause, as interpreted by the plaintiff, as an impermissible restriction on termination under Section 723(3) BGB. The plaintiff was ordered to pay the costs of the complaint proceedings.

Regeste Omnilex

§ 543 Abs. 2 ZPO; admission of revision by complaint against non-admission decision; the complaint is unsuccessful where neither fundamental significance nor a need for development of the law or for safeguarding uniform case law exists. A revision is not to be admitted merely because the lower court's assessment of a partnership pension clause appears arguable; if the challenged interpretation may amount to an impermissible restriction on termination under § 723 Abs. 3 BGB, this may support refusal of leave. Costs follow § 97 ZPO.

Tenor

Halbsatz ZPO abgesehen.

Die Klägerin trägt die Kosten des Beschwerdeverfahrens (§ 97 ZPO).

Question juridique clé

Whether the pension rule in the plaintiff's proposed interpretation constitutes an impermissible restriction on termination under Section 723(3) BGB.

Solution extraite

Motifs extraits

The court saw substantial support for the appellate court's assessment and therefore found no reason to admit the revision.

Question juridique clé

Allocation of the costs of the leave-to-appeal proceedings.
