Résumé Omnilex

The Federal Court of Justice rejected the defendants’ complaint against the Higher Regional Court of Munich’s denial of leave to appeal. It found that none of the statutory grounds for admitting revision under § 543 Abs. 2 ZPO were present, in particular no fundamental question and no need to secure uniform case law. The procedural objections raised by the defendants were examined and held to be without merit. The defendants were ordered to pay the costs of the complaint proceedings.

Regeste Omnilex

§ 543 Abs. 2 ZPO, § 544 Abs. 4 Satz 2 ZPO; complaint against refusal to admit revision: revision is admissible only if the statutory grounds are satisfied. The Federal Court of Justice may dismiss a non-admission complaint without detailed reasons where the complaint does not raise a qualifying question of fundamental importance and neither development of the law nor safeguarding of uniform case law requires a decision. Asserted procedural errors justify admission only if they are material and capable of affecting the result; mere invocation of procedural irregularities is insufficient when the court, after examination, finds them non-conclusive (consid. in substance).

Tenor

Halbsatz ZPO abgesehen.

Die Beklagten tragen die Kosten des Beschwerdeverfahrens (§ 97 ZPO).
