The Federal Court of Justice dismissed the plaintiff’s complaint against denial of leave to appeal. It held that the Higher Regional Court of Cologne had correctly found that the defendant’s product names and presentation did not amount to portraying products as imitations of the plaintiff’s perfumes within the meaning of § 6(2)(6) UWG and the corresponding EU provisions. The Court considered its prior case law and L'Oréal/Bellure and found no need for a reference to the CJEU. The complaint also failed to show any ground for revision under § 543(2) sentence 1 ZPO. Costs were imposed on the plaintiff.

Vergleichende Werbung: Darstellung eines Produkts als Imitation

Tenor

Die Beschwerde der Klägerin gegen die Nichtzulassung der Revision in dem Urteil des 6. Zivilsenats des Oberlandesgerichts Köln vom 28. November 2008 wird auf ihre Kosten zurückgewiesen.

Die Rechtssache hat keine grundsätzliche Bedeutung, die auf die Verletzung von Verfahrensgrundrechten gestützten Rügen greifen nicht durch und die Fortbildung des Rechts oder die Sicherung einer einheitlichen Rechtsprechung erfordern auch im Übrigen keine Entscheidung des Revisionsgerichts (§ 543 Abs. 2 Satz 1 ZPO).

Das Berufungsgericht hat rechtsfehlerfrei festgestellt, dass es sich bei den angegriffenen Bezeichnungen und Ausstattungen der Beklagten nicht um eine Darstellung von Produkten als Imitation oder Nachahmung i.S. von § 6 Abs. 2 Nr. 6 UWG, Art. 3a Abs. 1 lit. h Richtlinie 97/55/EG (Art. 3a Abs. 1 lit. h Richtlinie 84/450/EWG; Art. 4 lit. g Richtlinie 2006/114/EG) handelt. Es hat sich dabei in nicht zu beanstandender Weise auf die Entscheidung des Senats vom 6. Dezember 2007 (I ZR 169/04, GRUR 2008, 628 Tz. 26 = WRP 2008, 930 - Imitationswerbung) gestützt. Eine Vorlage an den Gerichtshof der Europäischen Union ist insoweit nicht geboten (vgl. BGH GRUR 2008, 628 Tz. 33 - Imitationswerbung).

Der von der Beschwerde mit Schriftsatz vom 6. Juli 2009 angeführten Entscheidung des Gerichtshofs vom 18. Juni 2009 (C-487/07, GRUR 2009, 756 - L´Oréal/Bellure) lag eine vergleichende Werbung durch Verwendung von Duftvergleichslisten zugrunde (vgl. EuGH GRUR 2009, 756 Tz. 52, 66 - L´Oréal/Bellure). Es war in jenem Verfahren unstreitig, dass die dort in Rede stehenden Vergleichslisten den Zweck und die Wirkung hatten, die betreffenden Verkehrskreise auf das Originalparfüm hinzuweisen, als dessen Imitationen die von dem Verwender der Vergleichslisten vertriebenen Parfüms galten, und deshalb von einer Darstellung als Imitation i.S. von Art. 3a Abs. 1 lit. h Richtlinie 84/450/EWG auszugehen war (aaO Tz. 76). Die genannte Entscheidung des Gerichtshofs steht schon aus diesem Grund der tatrichterlichen Würdigung des Berufungsgerichts nicht entgegen, im Streitfall könne nicht festgestellt werden, dass (auch) den beanstandeten Bezeichnungen und Ausstattungen die Wirkung zukomme, in vergleichbarer Weise darauf hinzuweisen, dass es sich bei den Produkten der Beklagten um Imitationen der Originalparfüms der Klägerin handele.

Das Berufungsgericht ist dabei in Übereinstimmung mit der Rechtsprechung des Gerichtshofs (vgl. EuGH GRUR 2009, 756 Tz. 75 - L´Oréal/Bellure) und des Senats (GRUR 2008, 628 Tz. 26 - Imitationswerbung; BGH, Urt. v. 1.10.2009 - I ZR 94/07 Tz. 29 - Oracle) zutreffend davon ausgegangen, dass eine Darstellung im Sinne der genannten Vorschriften keine explizite Bezeichnung als Imitation erfordert, sondern bereits eine implizite Bezugnahme auf das Originalparfüm genügen kann (BU S. 5 Abs. 2). Da das Berufungsgericht eine unlautere Imitationswerbung rechtsfehlerfrei verneint hat, fehlt es auch an hinreichenden Anhaltspunkten für eine unlautere Rufausnutzung (vgl. EuGH GRUR 2009, 756 Tz. 79 - L´Oréal/Bellure).

Von einer weitergehenden Begründung wird gemäß § 544 Abs. 4 Satz 2, 2. Halbs. ZPO abgesehen.

Der Streitwert für das Nichtzulassungsbeschwerdeverfahren wird auf 215.000 € festgesetzt.
