Résumé Omnilex

In a dispute concerning an internet-system contract terminated before completion, the Düsseldorf District Court considered the provider’s claim to remuneration under BGB § 649. It awarded €489.95, plus interest at eight percentage points above the base rate from 22 May 2015, and dismissed the remainder. Applying the statutory framework introduced for contracts from 1 January 2009, the court held that the provider bears the burden of proving saved expenses and omitted alternative earnings for the portion exceeding 5% of the agreed remuneration. The plaintiff was allocated 88% of the litigation costs and the defendant 12%.

Regeste Omnilex

BGB § 649; burden of pleading and proof for saved expenses and earnings from alternative work following termination of a work contract. The Federal Court of Justice’s approach under the former law concerning the burden of proof for omitted alternative earnings does not apply without qualification to contracts governed by § 649 sentence 3 BGB, effective for contracts from 1 January 2009. For the portion of the remuneration exceeding the statutory 5% amount, the provider bears the burden of pleading and proof that no earnings from alternative work were obtained. The customer’s simple denial is sufficient to put that matter in issue. The provider must substantiate and offer proof, in particular where it appears that staffing could have been planned in light of early contract terminations, that employees released from the work could not be deployed on other assignments.

The provider was entitled to €489.95 plus interest; the claim was otherwise unsuccessful. For amounts exceeding 5% of the agreed remuneration, the provider bore the burden of proving saved expenses and omitted alternative earnings.

The post-2009 version of BGB § 649, including subsection 3, limits the unrestricted application of the Federal Court of Justice's earlier burden-of-proof approach. A customer's simple denial of alternative earnings is sufficient as to the excess over the statutory 5% presumption; the provider must substantiate and offer proof, including that employees could not be assigned other work despite early termination.
