Tenor
Es wird festgestellt, dass die Klägerin im Hinblick auf die Zugänglichmachung der Bl. 21-23 der Akte dargestellten Fotos über eine zweite Webdomain ihres Internetauftrittes nicht verpflichtet ist, an die Beklagte Schadenersatz sowie vorgerichtliche Rechtsanwaltskosten zu zahlen und zwar insbesondere nicht Schadenersatz in Höhe von 1'162,50 Euro zuzüglich 130,50 Euro vorgerichtlicher Rechtsanwaltskosten wie beides mit Schreiben Kanzlei U & Partner vom 02.11.2012 verlangt.
Die Kosten des Rechtsstreits hat die Beklagte zu tragen.
Dieses Urteil ist hinsichtlich der Kosten vorläufig vollstreckbar.
Der Beklagten gestattet das Gericht, die Zwangsvollstreckung gegen Sicherheitsleistung in Höhe von 110 % des vollstreckbaren Betrages abzuwenden, wenn nicht die Klägerin vor der Zwangsvollstreckung Sicherheit in Höhe von 110 % des zu vollstreckenden Betrages leistet.
