Tenor

Die Beklagte wird verurteilt, an den Kläger 171 € zuzüglich Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 2.10.2012 zu bezahlen.

Im übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreites werden gegeneinander aufgehoben.

Das Urteil ist vorläufig vollstreckbar.

Den Parteien wird gestattet, eine vorläufige Vollstreckung der jeweils anderen Partei gegen Sicherheitsleistung in Höhe des jeweils zur Vollstreckung anstehenden Betrages zzgl. 10 % abzuwenden, wenn nicht die vollstreckende Partei zuvor Sicherheit in derselben Höhe geleistet hat.
