Düsseldorf District Court set the value in dispute at €982.92, including the value of the requested exemption from pre-litigation attorney fees insofar as it concerned claims not pending in court. It proposed that the defendants jointly pay €296.22 and reimburse €229.55 in pre-litigation attorney fees, with litigation and settlement costs set off against each other. Der Streitwert wird auf 982,92 € (=830,74 € + (272,87 € - 120,67 €)) festgesetzt.
Die beantragte Freistellung von den vorprozessualen Anwaltskostenwirkt streitwerterhöhend, soweit sie sich auf nicht rechtshängige Forderungen bezieht.
II.
Das Gericht regt an, sich auf folgender Basis zu vergleichen:
Weiter stellen die Beklagten die Klägerin von vorprozessualen Anwaltskosten in Höhe von 229,55 € gegenüber den Klägervertretern frei.
Streitwert für den Rechtsstreit und den Vergleich: 982,92 €
Die Parteien werden gebeten, binnen drei Wochen zum Vergleichs-Vorschlag Stellung zu nehmen.
Dem Vorschlag liegen folgende Erwägungen zu Grunde:
Das Gericht hat die von der Klägerin dargelegte Schadenshöhe zu Grunde gelegt, gegen die erhebliche Einwände nicht ersichtlich sind. Allerdings geht auch das Gericht davon aus, dass die Betriebsgefahr des Klägerfahrzeugs zu berücksichtigen ist. Hierbei hat es den von der Beklagtenseite angenommenen Prozentsatz von 25% berücksichtigt. Hinsichtlich der vorprozessualen Anwaltskosten hat noch kein Ausgleich durch die Beklagten stattgefunden. Das Gericht hat die auszugleichenden Anwaltskosten entsprechend den obigen Erwägungen bemessen.
III.
Das Verfahren wird erst fortgesetzt, wenn die Klägerindie Vorschussdifferenz eingezahlt hat oder sich die Zahlung eines weiteren Gerichtskostenvorschusses etwa wegen eines Vergleichsschlusses erübrigt.

The value in dispute is €982.92; the fee-exemption claim increases it to the extent it concerns claims not pending in court.
