Im Übrigen wird die Klage abgewiesen.

Das Urteil ist hinsichtlich der Kosten vorläufig vollstreckbar. Die Parteien können die Vollstreckung gegen Sicherheitsleistung in Höhe von jeweils 110 % des Vollstreckungsbetrages abwenden, wenn nicht die jeweils andere Partei vor der Vollstreckung Sicherheit in dieser Höhe leistet.
