Tenor
Es wird festgestellt, dass der Beklagten keinerlei Ansprüche finanzieller Art gegen die klagende Partei zustehen, insbesondere nicht aus einem angeblich abgeschlossenen Vertrag über die Aufnahme der klagenden Partei in die Onlinedatenbank der Beklagten. Dies gilt insbesondere auch für einen angeblich abgeschlossenen Vertrag mit angeblich jährlichen Zahlungsansprüchen der Beklagten über 569,06 €, für zwei Jahre also 1.138,12 €.
Die Beklagte wird verurteilt, die klagende Partei von den Kosten der Inanspruchnahme des Rechtsanwalts X, D freizustellen in Höhe von 130,50 € für dessen außergerichtliche Tätigkeit im Rahmen der Durchsetzung des negativen Feststellungsanspruchs gegen die Beklagte.
Die Kosten des Rechtsstreits hat die Beklagte zu tragen.
