Das Versäumnisurteil vom 04.02.2010 wird teilweise aufgehoben und wie folgt neu gefasst:
Die Beklagten werden gesamtschuldnerisch verurteilt, an die C Autovermietung + Leasing GmbH, Nstr. 00, 00000 E, 546,09 € zu zahlen.
Die Beklagten werden gesamtschuldnerisch verurteilt, den Kläger gegenüber seinen Prozessbevollmächtigten von der Zahlungsverbindlichkeit in Höhe von 289,17 € freizustellen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen die Beklagten gesamtschuldnerisch.
Das Urteil ist vorläufig vollstreckbar. Den Beklagten wird gestattet, die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrags abwenden, wenn nicht zuvor der Kläger Sicherheit in gleicher Höhe leistet.
