Following an oral hearing, the District Court of Düsseldorf ordered the defendant to pay the plaintiff €503.33, with interest from 18 August 2010, and €83.54 in extrajudicial legal costs, with interest from 12 April 2011. für R e c h t erkannt:
Der Beklagte wird verurteilt, an die Klägerin 503,33 Euro nebst Zinsen in Höhe von 5 %-Punkten über dem jeweiligen Basiszinssatz seit dem 18.08.2010 sowie weitere 83,54 Euro vorgerichtliche Rechtsanwaltskosten nebst Zinsen in Höhe von 5 %-Punkten über dem jeweiligen Basiszinssatz seit dem 12.04.2011 zu zahlen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen die Klägerin zu 2/3 und der Beklagte zu 1/3.
Das Urteil ist vorläufig vollstreckbar.
Die Parteien können die Zwangsvollstreckung durch den jeweiligen Gegner gegen Sicherheit in Höhe von 110 % des jeweils vollstreckbaren Betrages abwenden, wenn nicht dieser zuvor Sicherheit in gleicher Höhe leistet.
Der Streitwert wird auf bis 2.000,-- Euro festgesetzt.
