Die Kosten des Rechtsstreits trägt die Beklagte.
Das Urteil ist vorläufig vollstreckbar.
Der Beklagten bleibt nachgelassen, die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrags abzuwenden, sofern nicht der Kläger in gleicher Höhe Sicherheit leistet.
