Tenor

hat das Amtsgericht Düsseldorf

im schriftlichen Verfahren am 15.10.2009

durch die Richterin am Amtsgericht X

für Recht erkannt:

Die Beklagten werden verurteilt,

als Gesamtschuldner an den Kläger 328,94 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 29.05.2008 zu zahlen und

als Gesamtschuldner den Kläger von nicht anrechenbaren vorgerichtlichen Rechtsanwaltskosten in Höhe von 89,72 € freizustellen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits werden gegeneinander aufgehoben.

Das Urteil ist vorläufig vollstreckbar.
