Following a default judgment issued by Düsseldorf Local Court on 27 January 2009, the court held the oral hearing on 7 July 2009 and maintained that judgment. It amended the order only to provide that provisional enforceability would be governed by the present judgment. The defendant was ordered to bear the further costs. The judgment is provisionally enforceable, subject to security provisions allowing either party to avert enforcement by providing security of 110% of the enforceable amount.

für Recht erkannt:

Das Versäumnisurteil des Amtsgerichts Düsseldorf vom 27.01.2009 in dieser Sache wird aufrecht erhalten mit der Maßgabe, dass sich die vorläufige Vollstreckbarkeit nach diesem Urteil richtet.

Die weiteren Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist vorläufig vollstreckbar. Beide Parteien können die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des für die andere Partei aufgrund des Urteils vollstreckbaren Betrages abwenden, wenn nicht die andere Partei vor der Vollstreckung Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leistet.
