für Recht erkannt:
Es wird festgestellt, dass der Kläger gegenüber der Beklagten weder zivil-
noch öffentlich-rechtlich verpflichtet ist, ein im Frühjahr des Jahres 2007
an dem überdachten Freisitz der Laube von Garten Nr. X des Klein-
gartenvereins X e.V., XXXX mit einer Fläche von ca. 12,60 qm angebrachtes Wellplastik zu entfernen.
Die Kosten des Rechtsstreits werden der Beklagten auferlegt.
Dieses Urteil ist vorläufig vollstreckbar.
Die Beklagte darf die Zwangsvollstreckung gegen Sicherheitsleistung in
Höhe von 120 % des auf Grund des Urteils vollstreckbaren Betrages ab-
wenden, wenn nicht der Kläger vor der Vollstreckung Sicherheit in Höhe
von 120 % des jeweils zu vollstreckenden Betrages leistet.
Die Berufung wird zugelassen.
