Der Beklagte wird verurteilt, an den Kläger 729,58 Euro nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz hieraus seit dem 21.11.2007 zu zahlen und den Rechtsschutzversicherer S-AG von einer Forderung in Höhe von 120,66 Euro nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz hieraus seit dem 07.05.2008 zur Schadensnummer ## ### ###-#/### freizustellen. Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits trägt der Beklagte.
Das Urteil ist ohne Sicherheitsleistung vorläufig vollstreckbar. Der Beklagte darf die Vollstreckung durch Sicherheitsleistung oder Hinterlegung in Höhe von 120% des aufgrund des Urteils vollstreckbaren Betrages abwenden, wenn nicht der Kläger vor der Vollstreckung Sicherheit in Höhe von 120% des jeweils zu vollstreckenden Betrages leistet.
