Résumé Omnilex

In this consumer insolvency proceeding, Düsseldorf Local Court fixed the trustee’s remuneration at EUR 60,000 plus EUR 11,400 VAT, for a total of EUR 71,400. It held that where the insolvency estate is unusually large, the stepped scale under § 2(1) InsVV, rather than the linear scale under § 13(1) InsVV, should serve as the standard basis. Adjustment factors may be applied to that baseline. The court also fixed expenses at EUR 5,250 plus EUR 997.50 VAT, totaling EUR 6,247.50.

Regeste Omnilex

InsVV Art. 13 para. 1 and Art. 2 para. 1; remuneration of the trustee in consumer insolvency proceedings involving an unusually large estate. The linear remuneration under Art. 13 para. 1 InsVV is not the proper standard where the estate is unusually large. Instead, the stepped remuneration scale under Art. 2 para. 1 InsVV applies as the standard remuneration. On that basis, increases or reductions may be made by applying adjustment factors (relative capping).

The linear remuneration under § 13(1) InsVV is not the appropriate standard for an unusually large estate; the stepped scale under § 2(1) InsVV provides the basis for relative capping through increases or reductions.
