The District Court Düsseldorf partly upheld the plaintiff's claim concerning a modernization rent increase declared by letter of Verein X e.V. dated 29 September 2005. Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 21. September 2007

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Es wird festgestellt, dass die Beklagten als Gesamtschuldner verpflichtet

sind, aufgrund der mit Schreiben des Vereins X e.V. vom 29.09.2005 ausgesprochenen Mieterhöhungserklä-

rung beginnend mit dem 01.12.2005 monatlich eine Mieterhöhung (Moderni-

sierungszuschlag gem. § 559 BGB) in Höhe von jeweils 85,53 EUR an den

Kläger zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits werden den Beklagten als Gesamtschuldnern

auferlegt.

Das Urteil ist vorläufig vollstreckbar.

Die Beklagten können die Vollstreckung gegen Sicherheitsleistung in Höhe

des jeweils zu vollstreckenden Betrages abwenden, wenn der Kläger nicht vor der Vollstreckung in gleicher Höhe Sicherheit leistet.
